5-Year Limited Workmanship Warranty — Hardscape Installation
Garrison's Landscaping, LLC warrants its hardscape workmanship for a period of five years from the date of substantial completion, provided the project has been paid in full. This warranty applies only to defects caused directly by improper installation workmanship performed by Garrison's Landscaping, LLC.
If a covered workmanship defect occurs during the warranty period, Garrison's Landscaping, LLC shall have the right to inspect the project and determine, in its sole reasonable judgment, whether the issue is covered under this warranty. If covered, Garrison's Landscaping, LLC's sole obligation shall be to repair or correct the defective workmanship. No refunds, credits, consequential damages, or third-party repair costs shall be covered unless approved in writing by Garrison's Landscaping, LLC prior to any work being performed.
Warranty Exclusions
This workmanship warranty does not cover damage, movement, failure, discoloration, cracking, staining, settling, drainage issues, or other conditions caused in whole or in part by:
- Normal wear and tear, aging, weathering, minor settling, or normal movement of pavers, walls, steps, caps, joints, or base materials.
- Acts of God or weather-related events including excessive rain, flooding, hurricanes, severe storms, freeze/thaw cycles, ice, snow, drought, erosion, or ground saturation.
- Soil conditions outside the control of Garrison's Landscaping, LLC, including expansive soils, poor subgrade, uncompacted fill, underground springs, sinkholes, organic matter, buried debris, erosion, or subsurface water movement.
- Drainage conditions not included in the original scope of work, including water runoff from roofs, downspouts, neighboring properties, irrigation systems, pool systems, grade changes, or drainage systems installed or modified by others.
- Failure by the owner to maintain the hardscape properly, including failure to keep joints filled, maintain polymeric sand, clean drains, control weeds, manage water runoff, or reseal surfaces where applicable.
- Damage caused by others, including landscapers, contractors, utility companies, pressure washing, heavy equipment, vehicles, trailers, dumpsters, furniture, grills, fire pits, chemicals, salt, de-icing products, oil, grease, rust, or improper cleaning products.
- Alterations or repairs performed by anyone other than Garrison's Landscaping, LLC, including removal, resetting, cutting, patching, excavation, or modification of the hardscape after completion.
- Tree roots, shrubs, plant growth, burrowing animals, insects, or other natural causes affecting the base, pavers, walls, edging, steps, joints, or surrounding grade.
- Material defects or manufacturer-related issues including color bariation, efflorescence, surface texture, fading, chipping, cracking, dimensional variation, or product failure. Manufacturer defects are subject only to the manufacturer's warranty, if any.
- Customer-supplied, used, or existing materials including reused pavers, reused block, existing base, existing concrete, existing walls, or any portion not installed or supplied by Garrison's Landscaping, LLC.
- Retaining walls, seat walls, columns, steps, or structural features impacted by surcharge loads, vehicles, driveways, buildings, fences, pools, water pressure, slope movement, or undisclosed site conditions.
- Cosmetic conditions including minor unevenness, small gaps, stains, scratches, chips, color differences, polymeric sand haze, efflorescence, surface wear, or appearance changes that do not affect structural performance.
Owner Responsibilities
The customer is responsible for proper maintenance after completion, including managing water runoff, cleaning drains, maintaining joints, preventing weed growth, avoiding heavy loads, and protecting the installation from damage.
The customer must notify Garrison's Landscaping, LLC in writing within 30 days of discovering any claimed defect. Failure to provide timely written notice may void this warranty.
This warranty is non-transferable and applies only to the original customer on the contract. It is void if the balance is not paid in full, if the project is altered by others, or if the hardscape is used in a manner inconsistent with its intended residential purpose.
